Brain Damaged Girl Awarded £5.3 Million

A teenager who was left with severe brain damage after complications during her birth has been awarded damages worth £5.3 million.

Sophie Taylor, now 15, was starved of oxygen at birth and suffers from cerebral palsy as a result. Had she been born just six minutes earlier, the major injuries she sustained would most likely have been avoided.

Sophie now suffers from muscle spasms in all four limbs and has difficulty making herself understood. She is mostly confined to a wheelchair and requires around-the-clock assistance.

The Portsmouth Hospitals NHS Trust admitted liability for Sophie’s injuries and apologised to her and her family.

The settlement, which was approved by the High Court, will pay for the adaptation of the family home and the provision of the care and support Sophie needs.

The amount of the settlement in this type of case would be expected to be higher where the victim of the negligent treatment is a young person. The level at which damages are set depends on all the circumstances. Whilst nothing can adequately compensate for the loss of a person’s health and a normal way of life, a financial settlement can help the victim and their family adjust to the change in circumstances knowing that essential care needs can be met and paid for.
