What is a civil partnership?

A civil partnership is a legally-recognised union between two people of the same sex which grants them the right to the same legal treatment a married couple would expect across a range of issues.

The Civil Partnership Act was put into place in 2004 and was a ground-breaking piece of legislation in the UK, giving same-sex couples similar legal protections to married heterosexual couples. Same-sex couple of able to register their civil partnership as long as both parties are age 16 or over.

Although amendments to the Marriage Act in 2013 granted same-sex couples the right to legally marry, many still choose to opt for a civil partnership, which provides financial and legal protection without the religious connotations of marriage.

How do I dissolve a civil partnership?

Much like a standard divorce, civil partners must have been registered for at least 12 months before they are able to apply for their partnership to be dissolved. For this to be approved, you will need to establish the partnership has irrevocably broken down, and the court will need to be satisfied this has happened by the occurring of one or more of the following “four facts”:

  • Unreasonable behaviour
  • Two years’ separation and consent from both parties
  • Five years’ separation
  • Desertion

Should these be met, the court will grant a Dissolution Order, which ends the legal contract between the couple.

The legal process to formally dissolve a civil partnership does not include making final arrangements for children or financial settlements. Our team will work closely with you to ensure this is dealt with effectively and efficiently.
